[E-discussion]”Constitutional Package” for Gilgit – Baltistan
Dear readers
The current government of Pakistan has announced that a “comprehensive constitutional package” is being announced for the Gilgit – Baltistan region, officially known as Northern Areas of Pakistan. The proposed package has been presented as a panacea for some of the major deprivations of our region.
According to press reports a major part of the package would focus on “sturctural adjustments” in the administrative setup, like;

Creation of Azad Kashmir like government setup

Autonomous elected legislative body

Ministrial titles, perks and previleges for the ‘advisors’
-
Increase in the annual budget
Sungi Development Foundation and Pamir Times have joined hands to organize an online discussion on what the general public of the region think about the proposed constitutional package, or what changes would they like to see in the political setup of the region. What ever decision the Federal government is going to take we believe that there should be a participatory approach by government to include voices of the local communities to get to know what there demands are. No any constitutional package neither any administrative arrangement can be successful without consulting the local communities.
We urge all of you to participate in the discussion so that we can propose any suggestions about the real demands of the people of Gilgit-Baltistan region. We have to raise our voices and make our demands clear so we can put up concrete demands in front of the Government. We, people of the region, are equally responsible and accountable to take this issue seroiusly and contribute in whatever form we can, for the development of our region. We need to act timely so that no body including goverment can expolite us through any cosmeticc arrangments.

The Founder of Pakistan Quaid-e-Azam said that ‘ Hindus are the Big Pakistanis, this statement is for those hindus who joined Pakistan after partion of India & Pakistan and who love from Pakistan, but my statement according to this situation of Pakistan is that ‘ The People of GilgitBaltistan are the Big Pakistanis’, if we read the history of ‘Gilgit Baltistan’ the people of this region fight against the Dogra rule & conqured this region from enimies, the govt or any other military had no any role in this freedom,it is my appeal to the Govt of Pakistan to give the basic rights to the people of ‘GilgitBaltistan’, The Govt shoud give this region the status of separate’ Presidient & Prime Minister’ like azad kashmir, i know that this will not be possible in one night but the Govt of Pakistan and the people of GilgitBaltistan shoud take the most positive steps to make it possible,it is my appeal to my Govt of Pakistan because i don’t want to see the dark future of my country Pakistan,

I agree with the Shahid’s point but the question here is that whether our current leaders have the capacity to provide benefits of this package to the people of Gigit Baltistan. Do you think that our political leadership has all required capacities to do legislations, planning and policy making, social development in real sense and so on???? I am afraid that after having the titles of ministers and ministerial benefits they will be in Islamabad or aboard enjoying personal trips on the regional funds. You can historically review the contribution of all these ruling class in the development of country and currently the situation is not different you may witness most of the leading political leaders enjoying the international visits where the same time the nation is facing crisis.
all things which are currently under discussion and termed as package are basically our constitutional rights. But due to lack of unity and de-politicization of the local people we are among the segments who are enjoying all these rights very least. It would continue and happen again with us in future if the nation of Gilgit Baltistan will fighting each other on the basis of region, sect and race. Until and unless there is lack of political awareness we would be in the same situation in which we are currently. These packages can not do any thing in changing our situation. For it there is need to bring changes in our leadership, minds of leadership whether social, political or religious to look into the real issues of common people. Otherwise there would be endless lines crying for food and shelter, electricity, clean drinking water, education, heath facilities etc.
Please do understand that that there is need to scratch our heads and join our hands to show again the historical strength of the people of Gilgit Baltistan… then obviously the future would be prosperous.

time is now on, our status should be declared, whether we are Pakistani or not? lolly pops and sandwichs will not work! complete representation in NA assebly & senate should be given, I could agree with Shahid’s post whether these kind of Package why not for Punjab & Sindh?
It is really high time for pakistan because of the war against the terrorist, lets wait what is fall-out of the operation!
A constitutional package will solve the long standing issue of status .We need a consensus among the North people that what we want because in the Post has many options given,The NA Assembly should ask the Federal Government waht status they want,Province or AJK kind of set up or any other way to be the part of constitution.Indeed this issue needs immidietely solved.Becasue longstanding imbiguities over such problems like representationin parliament are not good for the political health of any country.
So hopes are there but home work needed from our parliamentarians in Chinar Bagh.
After beating all the drums, we’ll have a maximum incentive in the shape of AJK like setup.
Regardless of discussing whether it is enough or not, I would like to suggest that we need to address our internal weaknesses in terms of socio-political behaviour of our society so as to be able to reap maximum benefit out of the granted package.
For this purpose, a comprehensive political awareness campaign is inevitable throughout NAs by the dynamic forces of the region.
Our national unity (as Gilgit-Baltistan) has severly been shattered by a targeted strategy through secterianism thus creating mistrust and communicational gap among our communities. An enlightened nationalism (not separatism) can play an amalgamatic role to unite us for securing our larger interests of peace, prosperity and harmony.
Unfortunately, politics in the country has become a a trade rather than service and elections used to be a “political stock exchange” where votes are traded as shares.
We need to educate people about how to “honour” it as “dignity” rather than selling it as a commodity.
Any candidate offering money should be discourraged during election campaigns.
To say that we need extraordinary efforts to make something out of nothing.

First of all thanks to The Pamir Times for providing us an opportunity to share our views on this important topic.
I don’t need to make a scenario because every one knows what our present status is in the constitution of Pakistan. I would like to share some ideas related to budget and finance.
Lets first see what we are providing to Pakistan in terms of finance and benefits convertible to money.
First of all our area is the best in tourism which provide millions of foreign exchange in the national exchequer. We provide the road and air route to the country which otherwise could had not been possible or at a high cost in terms of royalty and taxes. The life blood to Pakistan almost the 70% of the water which could otherwise had cost billions of rupees as is India treating . Pakistan is earning millions of dollars from the export of gems which come from the area. The Sost Dry Port which on average contributes Rs.2 Billion every year, to the national exchequer.
Now lets don’t ask them much they are poor nation, but ask them to at least give us back 10% o f the finance we give them.
The package I would consider should be broad based covering all areas through which they can win the hearts of the people which can be the following
A specific name for the area
Representation both in national assembly and senate
An autonomous assembly like provincial assemblies
A minister separately belonging to the area
Yearly Budget to be increased to Rs.20 billon.
Seats in universities to be doubled.

This is a good initiative by PT and SUNGI.
Lets hope this proposals and deliberations once concluded and summarized reaches the table of the PM and the President before they make any decisions about this unfortunate people and the area!
While we have seen ‘packages’ come and go for the last 60-64 years, lets be realistic that NO Pakistani government in Islamabad is going to do any substantial structural changes in the status of Gilgit-Baltistan, because of its complicated links to the resolution of Kashmir problem and the geo-politics surrounding the western borders of China, without the consent of China and the powers that be.
This means in real sense lets discuss what Islamabad and Pakistan is unable to give to us, or what we are unable to get from:
1. Status of 5th Province- Forget about it. after all we know, what Baluchistan and NWFP is getting though they have this status??
2. FATA like Status: Representation in Parliament. NO way, given the peculiar demography of Gilgit-Baltistan and its links with Kashmir problem.
3. Kashmir-like status: Islamabad and the politcians will say it,and our politicians will buy it, but in reality KANA and the Pakistani establishment will never give anything like that. It will be the same old wine in a new bottle! There are many reasons for that; power politics, resources required, corruption, red tapism, security sensitivities etc.
So we are left with the only option, i.e., an enlarged NALA which makes ‘NALA u Fughan’, but gets little powers, executive, administrative and financial. The la-Musharaf package with a PPP brand!
Whatever Islamabad offers as package and however colours it, our officials and politicans will accept it, as they did in the Past, and shall be happy strengthening the politician.corrupt official-timber mafia-corruption contractor nexus.
Peoples Proposal:
Whatever they do to change the NAGO , which is top down and never reaches the poor in the villages, as a first step in this long struggle, lets ask for:
A decentralized local government system and changing the Northern Areas local government ordinance 1979, and bringing about changes from the grassroots level.
1. Provide financial, administrative and executive powers to Village Council, Union Councils, Municipal/Town Committees and district councils; increase their funding and local legislative powers, build their capacities through creating partnerhsips with local communities, civil society and the private sector;
2. Create NA level and district level, funds and incentives for encouraging civil society and the private sector to develop and implement project and programmes for poverty reduction, social development and sustainable development with particular consideration to mountain area development;
3. Establish a multistakeholder development mechanism at NA and district levels, with representation from the pulbic representatives, government, civil society and the private sector, with the responsibility to plan, oversee and advise development policy making and allocation of funds to various sectors and actors.

Great analysis of the fortthcoming package,But lets also anaylysis the changing political dynamics on the national scale,We appreciate the vision of the PM and President who have now decided to eraicate all the reservations and the sense of deprivation from the constitutional rights among public.You are talking about the mindset of beaurocracy and governments in the past but now its a democatic government which believes in an end to regional rights issues .I am sure we will send ou parliamentarians soon to the National Assembly where they can advocate our people and highlight problems.

In the past we have seen democracies and dictatorships acting in unisum when it comes to GB’s constitutional and political rights.
Lets hope for the best.
More then that lets pray that Pakistani establishment and the current democractic government is able establish the writ of the state on its constitutional federating units and provides basic human rights to its own legitimate citizens, before it reaches out to solve the issues and challenges of GB and Kashmir that are still outside the ambit of the constitution of Pakistan.

the real issue for the people of gilgit baltistan is not cosmatic constitutional setup replacing terminologies such as chief executive, advisor, etc. it is the matter concerning the identity, unconditional right of self governance, right of self determination to decide freely their future and recognition and respect of ownership of the local populace over their natural resources with the authority to control and benefit. will the upcoming package provide such basic rights. simply the answer is NO it is not going make an end with the colonial system. it is not going to give politico-cultural identity.
in fact is is a mere eyewash to hoodwink the international communityand to appease the local people with a “new” setup. it is being brought in to balance pakistan government’s inhuman face that has been disclosed in the Emma B. Nicholson report of European Parliament last year.

Your reservations and predictions are extremely close to the reality.
The only thing you’ve not mentioned is that the Kashmiri people are’nt an interest for PAK-INDIA but their resources, particularly ‘THE WATERS’ of Kashmir??? which irrigates the both lands. So, we’re sandwtiched between the three nuclears, Pak, India and the giant CNINA. What can we expect farther???
We only need to raise maximum awareness in our community to understand and act accordingly in a safe manner to voice our legitimate concerns/demands/requirements at an international level through peacefull struggle.
The sheeps /goats will never give milk unless the shepherds do not herd them in a lucritive meadow? I mean a grassroot level awareness, even if it takes another 25 years.
We need to begin from the coming elections. As long as we continue to choose MIRS, we’ll be left as we are.

I tend to agree with what you said.
Just share a story. Some years back I was in an official meeting and a senior bureacrat said, why GB was important for Pakistan; our no 1 interest is Water, the Indus flows from here and irrigates Punjab and the plains of Pakistan,and here lies the greatest potentials of water reservoirs and hydropower potential. No 2, this is the only border which links Pakistan with China, our strategic and time tested friend; no 3, this is the only border of Pakistan where three international borders meet, India, Afghanistan and China and provides a corridor to link to central Asia. So this region is close to our heart and don’t be mistaken, Pakistan will NEVER abandon claim to this region, whatever the people of the area may aspire!
So, if these are the strategic interests of Pakistan in GB, what is the win-win situation here, which leaders and politicians of GB has to create an opportunity out of? What is the trade of here? Are we able to say that our interests and your interests converge? However, the win-win situation could only emerge if Pakistan, first accepts us as full citizens of this country, accepts our cultural and national identity, agrees to the concept of self-determination of the people and let the people of the area self-govern themselves, as Sultan Madad has said in his posting.
The problem with this process is two-fold; first, the Islamabad establisment is thinking in an exploitative model, as they treat Baluchistan adn the smaller provinces; secondly, our self serving politicians and representatives lack the vision, leadership and guts to advocate their case and to mobilize the people.
There is only one ray of hope, the youth and the civil society, which is still disorganized and lack direction and leadership. Lets channel this resource and energy from the grassroots and lets create a space at the lower level, where they are able to demonstrate leadership and learn to deal with public policies and mobilization of the people. In the long-term, they will, lets hope, be the torch bearers of promoting the noble cause of freedom, justice, equity and self-determination and self-governance.

The answer lies in this statement. Pakistan will never abandon the claim – agreed – but will it ever be able to annex the region on constitutional basis? A BIG NO
In order for Pakistan to ‘own’ GB on legal basis, Indian parliament – both houses – will have to change Indian constitution with a two third majority granting Pakistan the right to keep what it controls now i.e. AJK and GB. Since no Indian parliament can afford to give away 76,000 + 14,000 square kilometers of ‘integral’ land to any other country, Pakistan is left with one option: to annex GB unilaterally and change her own constitution to make it a legal part of the country.
Now here, we are dealt with two challenges. Firstly, what is the possibility that Pakistani law makers will amend their constitution to let go of Kashmir issue and keep what it controls in the form of GB and AJK? In my opinion, there is very remote chance that military establishment will let that happen.
Secondly, even if the military establishment lets that happen and merges GB with Pakistan, what is the gaurantee that India will not retaliate and take the case to the international bodies demanding Pakistani withdrawal?
In the 40s and 50s, when UNO asked Pakistan to withdraw from GB and AJK, western countries did not pressure Pakistan to abide by UN resolutions, as they needed Pakistan in CENTO and SEATO. But today the situation is different. Today, Pakistan is an isolated country. It is a scary depiction of economic and diplomatic failures. Every western country is waiting for a chance to punish Pakistan for disloyalty and double cross. Under the circumstances, there is a very little chance that international community will stand with Pakistan against India.
So Pakistan is not ready to take a chance of unilateral annexation of GB, since it will be dismissed by the Kashmiris and Indians.
The only option that Pakistani officials are left with is to repeat the mantra of “”Pakistan will NEVER abandon claim to this region””. Which means, we do not have the will or the capacity to have GB legally but we will maintain the status quo and will not let the people of GB decide either.
Storyline: Pakistan is not maintaining our disputed status because our votes are needed during the ”so-called plebiscite on Kashmir”. Pakistan is doing so because it needs India’s green signal and final approval to legally annex GB. But since Pakistani officials are victim of their own ego and myths, they will not admit to us that it is India which holds the final say in whether GB becomes part of Pakistan or not.

Never passed and lived my mind for seconds to engage in electoral politics. besides ‘mild opinions’ alone don’t make one a good mobilizer or an honest public representative!!
however, having said that, there are dozen other ways to organize and mobilize the people, to voice our concerns and exercise our democratic rights, be it researcher, analyst, idealogue, journalist, practitioner, party worker, rights activist, social activist or public rep.
Lets, each of us, contribute in our own way, and let the voters decide what their choices and preferences are through their parties and groups.

We appreciate the announcement from the Federal Government of akistan that finally the Federation has decided to establish the “Status of the Northern Areas” in the consititution of Pakistan. We hope that the government will at first work on the following two options;
1. Give the area a semi independent status such as AJK government OR
2. Will declare it as the fifth province of Pakistan by giving it some seats in the National Assembly & upper house as well as an important unit in the Federation.
**To do either of this consitutional amendments and resolutions will be required from the Parliament.
Let us hope some right decisions in the right direction will take place.We also request our own elected representatives to play an active role in this process, especially those who know the legal implications of any decision on this long-standing issue.

گلگت ( شراف الدین فریاد+ عمران حسین ) جماعت اسلامی گلگت بلتستان نے حکومت سے مطالبہ کیاہے کہ گلگت بلتستان کو ایک بااختیار آئینی سیاسی سیٹ اپ دیاجائے اورمتوقع پیکج سے قبل گلگت بلتستان کے سیاسی ، دینی اور قوم پرست جماعتوں سمیت عوام کو اعتماد میںلیا جائے ۔ اگر ماضی کی طرح اس دفعہ بھی گلگت بلتستان کوکٹھ پتلی سیٹ اپ دیا گیا تو یہاں کے عوام اسے ہرگز قبول نہیں کرینگے ، جماعت اسلامی گلگت بلتستان کے امیر مشتاق احمد ایڈووکیٹ نے اپنی جماعت کے دوسرے رفقاءکے ہمرا ہ گلگت میں مقامی صحافیوں کو بریفنگ دیتے ہوئے کہا کہ گلگت بلتستان کیلئے آزاد کشمیر طرز کاسیٹ اپ ہی سب سے بہتر رہے گا ، کیونکہ اس علاقے کو پاکستان میں شامل کردینے کی صورت میں کشمیر عملاً تقسیم ہو جائے گا اورپاکستان کااصولی موقف ختم ہو جائے گا ۔ اقوام متحدہ اوردیگر عالمی اداروں میں دوبارہ مسئلہ کشمیر پیش نہیں کیاجاسکے گا ، اس کے علاوہ مقبوضہ لداخ کے بدھسٹ اورجموں کے تین ہندو اکثریتی اضلاع جموں ، ادھم پور اور کھٹو عد جو پہلے ہی انڈین یونین میں شامل ہونا چاہتے ہیں ۔ پاکستان کے اس اقدام سے بھارت کویہ جواز ملے گا کہ وہ ریاست کے ان حصوں کو انڈین یونین میں ضم کردے اوران علاقوں کو پاکستان میں شامل کردئیے جانے کا یہ بھی نقصان ہوگا کہ کشمیر میں استصواب رائے کی صورت میں پاکستان گلگت بلتستان کے تقریباً 15 لاکھ ووٹ سے محروم ہوگا اس تقابلی جائزہ ، مذکورہ بالا حقائق اورسپریم کورٹ کے فیصلے کی روشنی میں گلگت بلتستان کو پاکستان کے صوبے کاسٹیٹس دینا خود پاکستان کے مفاد میں نہیں ہے ۔ انہوں نے کہاکہ دوسری جانب گلگت بلتستان کو آزاد کشمیر کے ساتھ شامل کرنا بھی اب عملاً ناممکن ہے ۔لہٰذا کوئی ایسی راہ تلاش کرنا ہوگی جس کے نتیجے میں نہ مسئلہ کشمیر پاکستان کا اصولی موقف متاثر ہو اورنہ ہی بھارت کوتقسیم کشمیر کاجواز فراہم ہو اسی پس منظر گلگت بلتستان کے عوام کو آئینی وسیاسی وبنیادی حقوق کیلئے راستہ نکالنا ہوگا ۔ مشتاق احمد ایڈووکیٹ نے کہا کہ گلگت بلتستان کی تاریخ ، سیاست ، مسئلہ کشمیر کے تناظر میں پاکستان کے اصولی موقف اورسپریم کورٹ کے فیصلے کی روشنی میں یہ نکات سامنے آتے ہیں کہ ریاست جموں وکشمیر کاحصہ رہتے ہوئے گلگت بلتستان میں ایک منتخب با اختیار حکومت ، قانون سازاسمبلی اورآزاد عدلیہ کا قیام عمل میں لایا جائے اوراس مقصد کیلئے آزاد کشمیر کا نظم وضع کرتے وقت جوطریقہ کار اپنا یاگیا تھا ، بالکل ایسا ہی یا اس سے ملتا جلتا طریقہ کاراپنا جائے تاکہ اختیارات کاوزارت امور کشمیر سے گلگت بلتستان منتقل کئے جانے میں کوئی امر مانع نہ ہو ، موجودہ کشمیر کونسل اورکشمیر سے متعلق حکمت عملی طے کرنے کیلئے براہ راست پاکستان کی لیڈرشپ سے رابطے کاایک ذریعہ ہے ۔لہٰذا اس ادارے کا دائرہ کار گلگت بلتستان کے علاوہ مقبوضہ کشمیر کے تحریک آزادی سے منسلک حریت کے نمائندوں تک پھیلا کر ایک اعلیٰ تنظیمی مشاورتی ادارہ بنایاجائے تاکہ مسئلہ کشمیر سے متعلق تینوں خطوں کاکردار متعین کیاجائے ۔ گلگت بلتستان کے عوام کو وہ تمام بنیادی انسانی وقانونی حقوق حاصل ہونے چاہیں جو پاکستان کے دیگرصوبوں اورآزاد کشمیر کے عوام کو حاصل ہیں ۔گلگت بلتستان کا منتظم اعلیٰ ( چیف ایگزیکٹو ) کا تعلق گلگت بلتستان سے ہو اور وہ قانون سازاسمبلی کا منتخب نمائندہ ہو ، جسے وہ تمام اختیارات حاصل ہو جو پاکستان کے ایک صوبے کے وزیراعلیٰ کوحاصل ہیں اورچیف ایگزیکٹو وفاق میں وزیراعظم جبکہ مقامی سطح پر قانون سازاسمبلی کے سامنے بیوروکریسی چیف ایگزیکٹو کے سامنے جواب دہ ہوں ۔ گلگت بلتستان سے متعلق تمام معاملات وامور کانا ڈویژن کشمیر وشمالی علاقہ جات کے اختیارات کی نوعیت اسی حد تک رہے جتنی آزاد کشمیر سے متعلق ہے ۔ تمام مالیاتی اورانتظامی اختیارات قانون سازاسمبلی کے سپرد کئے جائیں اور وزارت امور کشمیر وگلگت بلتستان میں تعینات بیورو کریسی کے مابین مکمل ہم آہنگی کیلئے اختیارات میں توازن پیداکیاجائے ۔ گلگت بلتستان چیف کورٹ کی از سرنو تشکیل کی جائے اوراسے حقیقی معنوں میں ہائی کورٹ کادرجہ دیاجائے جبکہ سپریم اپیلٹ کورٹ کیلئے وہی اختیارات اورمعیار ہو جوسپریم کورٹ کیلئے مقرر ہے اورججز کی مراعات ومعیار بھی ان کے برابر کئے جائیں ۔عدلیہ کو انتظامیہ کی مداخلت سے بالکل آزاد کیاجائے اورججز کی تقرری ، ترقی اورتبادلے کا آزادانہ وشفاف نظام وضع کیاجائے ، اس کے علاوہ گلگت بلتستان میں ملازمتوں میں تقرری کانظام بھی شفاف ہونا چاہیے ،پریس بریفنگ دیتے ہوئے جماعت اسلامی گلگت بلتستان کے امیر مشتاق احمد ایڈووکیٹ نے مزید کہا کہ پاکستان کی سول اورفوجی حکومتوں کی پالیسی روز اول سے گلگت بلتستان سے متعلق گو مگو کاشکار رہی ہے یہی وجہ ہے کہ حکومت پاکستان گلگت بلتستان کے حوالے سے کوئی دوٹوک موقف اختیار نہیں کرسکتی ہے ۔1950 اور1960 کی دہائیوں میں اس بات کازیادہ امکان تھا کہ کشمیر میں اقوام متحدہ کے زیراہتمام رائے شماری کروائی جائے اوریہ امکان آج بھی بدرجہ اتم موجود ہے جس کا خیال رکھنا ہوگا ۔ انہوں نے کہا کہ حکومت کامتوقع پیکج کیساہے اس کے بارے میں کچھ کہنا قبل ازوقت ہے مگر ماضی کی طرح بے اختیار سیاسی سیٹ اپ اب یہاں کے عوام برداشت نہیں کرسکیں گے ، آئینی ،سیاسی وبنیادی حقوق کامطالعہ یہاں کے عوام کے جمہوری حق ہے ۔لہٰذا اس حق سے محروم رکھنا سنگین غلطی ہوگی۔
